Since the creation of our firm in 1955, (this is our 50th anniversary year) the firm has always held these two fundamental ideals:

First of all, we believe that experience we have in the bureaucratic procedures of the different Official Entities, both Spanish and foreign (Spanish Patent and Trademark Office) allows us to offer direct and extensive knowledge of the specific ways in which each one of them works, knowing as we do the various different ways in which they function, being able to incorporate these in our dealing with them right from the beginning, thus avoiding delays and incurring in unnecessary extra expenses. |

Secondly, we would like to point out that most Industrial Property Rights are tenured for a long period of time, Patents for twenty years and those relating to Trademarks indefinitely, so the constant control, vigilance and supervision of files has to be guaranteed. This is the reason why many professionals in other countries trust in a firm like ours that has proven to be stable. Important companies have already suffered the closure of firms that had solvency problems, leaving behind them the loss of trademarks and annulment of patents. |

Finally, and perhaps most importantly, we would like to point out that since the enforcement of the new Trademark Law, the Spanish Patent and Trademark Office does not directly watch over previous trademarks, just as neither do the OHIM in relation to Community Trademarks, nor the WIPO does in relation to International Trademarks. In practical terms, this means that if a third party files a similar or identical trademark to one which already exists, and if the person who holds the tenure of the earlier rights does not detect the publication in the official bulletins, and does not file the corresponding writ of opposition in the correct way and within the specified time limit, then this new registration is granted straight away, and in order to annul it, it is necessary to go through a lengthy and expensive legal procedure. Obviously, the truth of the matter is that it is rather complicated for companies to read through the Official Bulletins, (of which there are at least three), and which are published twice a month, in order to check for any new publication in any country. For this reason our offices are equipped with state of the art computer technology where the staff can quickly detect any incidences and inform our clients in the shortest period of time. |
